Terms and Conditions for the BAS FAST Platform

Legal and Operational Notice

BAS FAST is operated locally by BAS FAST Company under the applicable authorization framework in North and East Syria.

Emitis Group Ltd, United Kingdom, acts as the authorized app publisher, technology provider, software provider, and/or brand licensor for the BAS FAST application.

Emitis Group Ltd does not provide regulated financial services, banking services, electronic money services, money transmission services, or payment services in the United Kingdom, European Union, or United States through the BAS FAST application.

All financial wallet services, local payment services, cash-in and cash-out services, agent services, KYC procedures, customer support, and operational financial activities made available through BAS FAST are provided within the applicable local authorization and operational framework in North and East Syria, and not as regulated financial services offered by Emitis Group Ltd in the United Kingdom, European Union, or United States.

1. Introduction

Welcome to BAS FAST.

These Terms and Conditions govern your use of the BAS FAST application, website, electronic wallet, digital payment services, transfers, QR code payments, cash-in and cash-out services, agent services, merchant services, and related support services.

BAS FAST is an electronic wallet and digital payment service owned and operated by Emitis Group. BAS FAST provides its services in accordance with the operational licenses and approvals issued by the competent authorities in North and East Syria, and in accordance with the policies and procedures approved for the service.

These Terms constitute a legally binding agreement between you and BAS FAST. By creating an account, using the application or website, or using any BAS FAST service, you acknowledge that you have read, understood, and agreed to comply with these Terms.

If you do not agree to these Terms, you must not create an account, use BAS FAST services, or continue using them.

2. Relationship Between These Terms and Other Policies

These Terms operate together with the other BAS FAST policies in an integrated manner, and none of them cancels the others.

The policies related to these Terms include, for example:

• Privacy Policy.

• Data Protection and Information Security Policy.

• Cookies and Tracking Technologies Policy.

• Any compliance, KYC, AML/CFT policy, or other operational instructions adopted by BAS FAST.

• Any notices, instructions, limits, or fees displayed inside the application, website, or official channels.

In the event of any apparent conflict between these Terms and any other policy, the documents shall be interpreted in an integrated manner.

The Privacy Policy shall be the primary reference for matters relating to data collection, use, sharing, and user rights. The Data Protection and Information Security Policy shall be the primary reference for matters relating to protection, security, and technical risk management, while these Terms shall be the primary reference for the legal, operational, and commercial relationship between the user and BAS FAST.

3. Definitions

For the purposes of these Terms, the following terms shall have the meanings set out below, unless the context requires otherwise:

• BAS FAST: The BAS FAST platform, its electronic wallet, and its financial, technical, and operational services.

• The Company: Emitis Group, in its capacity as the owner, operator, or supporting entity of the BAS FAST service, or any related legal entity that may later be approved to operate the service.

• The Service: All services provided by BAS FAST through the application, website, agents, or official channels.

• User: Any natural or legal person who uses or attempts to use BAS FAST services.

• Customer: The user whose request has been accepted and whose account has been successfully activated within the BAS FAST platform.

• Account: The electronic account created in the user’s name within the BAS FAST platform.

• Wallet: The electronic financial account through which balances are held and transactions are carried out.

• Balance: The financial value recorded in the user’s account within the system.

• Transaction: Any financial or operational process carried out through BAS FAST, such as transfer, payment, cash-in, cash-out, settlement, refund, freezing, or review.

• Internal Transfer: The transfer of funds or balance between BAS FAST accounts within the platform.

• External Transfer: Any transfer or financial service outside the scope of the BAS FAST platform or through channels, parties, or limited operational arrangements approved by BAS FAST, if available.

• Agent: Any person, center, or entity authorized by BAS FAST to provide specific services such as cash-in, cash-out, verification, or customer service.

• Merchant: Any person, company, or entity that accepts payment through BAS FAST in exchange for goods or services.

• KYC: “Know Your Customer” procedures used to verify the user’s identity and understand the nature of the user’s use of the service.

• CDD: Customer Due Diligence.

• EDD: Enhanced Due Diligence in high-risk cases.

• AML/CFT: Anti-Money Laundering and Counter-Terrorist Financing procedures.

• Compliance: The commitment of BAS FAST and its users to the applicable regulatory, supervisory, contractual, and operational requirements.

• Beneficial Owner: The natural person who owns or controls, directly or indirectly, an account, activity, entity, or related funds.

• OTP: A temporary verification code used to confirm the user’s identity or execute sensitive procedures.

• Multi-Factor Authentication: Any additional verification method used by BAS FAST to confirm the user’s identity when logging in, executing transactions, or modifying account data.

• Official Channels: The official application, official website, authorized agents, service centers, official email addresses, and any channel officially announced by BAS FAST.

• Force Majeure: Any event beyond the reasonable control of BAS FAST, such as wars, disturbances, electricity or internet outages, disasters, official decisions, large-scale cyberattacks, or failure of external infrastructure.

The headings contained in these Terms are included for ease of reading only and do not affect the interpretation of the text or its legal scope.


4. Acceptance of the Terms

Any of the following actions constitutes your express acceptance of these Terms:

• Creating an account with BAS FAST.

• Using the application or website.

• Executing any transaction.

• Using cash-in or cash-out services.

• Making a QR payment.

• Using agent or merchant services.

• Contacting support regarding an account or transaction.

• Continuing to use the service after an update to these Terms is published.

You acknowledge that your electronic acceptance of these Terms has legally binding effect and is equivalent to written acceptance to the extent permitted by the applicable rules.

5. Eligibility and Minimum Age

BAS FAST may not be used by anyone under the age of 16.

If you are under the legal age of majority according to the applicable law, BAS FAST may request the consent of a parent or legal guardian, impose restrictions on the account or certain services, or refuse to open or restrict the account.

By using the service, you acknowledge that:

• You have reached the minimum permitted age.

• You have the legal capacity to use the service.

• You are using the service for yourself or as an authorized representative of a legal entity.

• All data and documents you provide are accurate, complete, and up to date.

BAS FAST may refuse, suspend, or close any account if it appears that the user does not meet the age, eligibility, or verification requirements.

6. Types of Accounts

BAS FAST may, according to its operational policies, provide different types of accounts, including:

• Individual accounts.

• Merchant accounts.

• Company accounts.

• Agent accounts.

• Other operational or institutional accounts.

The requirements for each type of account may differ in terms of:

• Registration data.

• KYC requirements.

• Usage limits.

• Fees.

• Permissions.

• Available services.

• Review and compliance.

• Risk level.

BAS FAST is not obligated to make all account types or all services available to all users, in all regions, or at all times.

7. Account Creation

To open an account with BAS FAST, you must provide the required data and information accurately and truthfully, which may include:

• Full name.

• Phone number.

• Email address, if available.

• Date of birth.

• Address or area.

• Occupation or nature of activity.

• Identity document.

• Regular personal photo.

• Any additional information required for verification, compliance, or service operation.

BAS FAST reserves the right to:

• Accept or reject an account creation request.

• Request additional information or documents.

• Delay account activation until verification is completed.

• Restrict certain services until KYC is completed.

• Reject the account if the data is incorrect, incomplete, inconsistent, or suspicious.

The user may not create an account in another person’s name, use documents that do not belong to the user, provide misleading data, or open an account on behalf of another person without clear authorization acceptable to BAS FAST.

8. Accuracy and Updating of Data

The user acknowledges and warrants that all data, information, and documents provided to BAS FAST are:

• True, accurate, and complete.

• Not misleading or forged.

• Belonging personally to the user, or provided under the user’s legal authority.

• Up to date and reflecting the actual status of the user or the entity represented by the user.

The user must update the user’s data immediately upon any material change, including:

• Change of phone number.

• Change of email address.

• Change of identity document.

• Change of residence or workplace.

• Change in the nature of activity or level of use.

• Any event that may affect verification, compliance, or account security.

The phone numbers, email addresses, and communication methods registered with BAS FAST are considered approved communication methods for sending notifications, verification messages, alerts, codes, and any legal or operational correspondence related to the service.

9. Identity Verification KYC

Given the nature of BAS FAST as an electronic wallet and digital payment service, BAS FAST has the right to apply KYC, CDD, and EDD procedures according to the risk level, account type, and nature of use.

Verification procedures may include:

• Verifying identity documents.

• Verifying the phone number.

• Verification via WhatsApp, email, or OTP.

• Reviewing the regular personal photo.

• Requesting information about the source of funds or purpose of use when needed.

• Requesting company, merchant, or authorized signatory documents.

• Identifying the beneficial owner in business or institutional accounts.

• Human or automated review of certain accounts or transactions.

BAS FAST may request re-verification or update of user data at any time, especially when:

• Account data changes.

• Activity volume increases.

• Unusual activity occurs.

• Risk indicators exist.

• A request is made by a competent authority.

• Compliance or account protection requires it.

If the user refuses to provide the required information or provides unreliable information, BAS FAST may restrict the account, suspend the service, reject transactions, or close the account as it deems appropriate.

10. Enhanced Due Diligence EDD

BAS FAST may apply enhanced due diligence to accounts, transactions, or categories that it considers high risk.

Cases that may require enhanced due diligence include, for example:

• High-value transactions.

• Unusual or complex patterns.

• Suspicious repetition of transactions.

• Unclear business relationships.

• Indicators of conflict, concealment of ownership, or unclear representation.

• Accounts, activities, regions, or sectors considered high risk.

• Any other case that BAS FAST considers to require deeper review.

Enhanced due diligence procedures may include:

• Requesting additional documents.

• Verifying the source of funds or source of wealth.

• Requesting an explanation of the purpose of the transaction.

• Obtaining additional internal approvals.

• Expanded human review.

• Increasing the frequency of monitoring.

• Imposing additional limits.

• Delaying execution until the review is completed.

11. Business and Company Accounts

When opening a merchant, company, or institutional account, BAS FAST has the right to request additional information and documents, such as:

• Registration or licensing documents.

• Documents of authorized signatories.

• Ownership and control data.

• Identification of beneficial owners.

• Nature of business activity.

• Purpose of using the account.

• Estimated expected transaction volumes.

• Any necessary financial, operational, tax, or regulatory documents.

BAS FAST may refuse, suspend, or restrict the business or institutional account if verification requirements are not completed or if risk indicators or lack of clarity appear regarding ownership, activity, or authority.

12. Account Use and Protection

You are responsible for protecting your account and your access methods.

The user must:

• Keep the password and PIN confidential.

• Not share OTP codes with any person.

• Not hand over the account, phone, or SIM card to any third party.

• Use the official application only.

• Not use modified or untrusted applications.

• Notify BAS FAST immediately if the phone is lost or account compromise is suspected.

• Update the phone number or email address when they change.

• Ensure logout from the account when using shared devices, if any.

• Not allow any other person to use the account.

Transactions carried out from the user’s account or device, or using the user’s verification methods, shall be deemed issued by the user unless proven otherwise according to a review accepted by BAS FAST.

BAS FAST shall not be responsible for losses resulting from the user sharing the password, PIN, OTP, or login data, or using unofficial channels.

13. OTP Verification Codes and Security Notifications

BAS FAST may use OTP codes and additional verification methods to confirm the user’s identity or protect sensitive transactions.

OTP may be sent through:

• WhatsApp.

• Email.

• Application notifications.

• Any other official channel that BAS FAST may later approve.

The user may not share the OTP code with any person, including agents, support employees, or any party claiming to represent BAS FAST.

BAS FAST may refuse to execute a transaction or change account data if the user’s identity cannot be verified or if security risk indicators exist.

 14. Available Services

Depending on the account type, limits, and approved policies, BAS FAST may provide the following services:

• Opening and managing an electronic wallet.

• Holding electronic balance within the account.

• Internal transfers between BAS FAST users.

• Certain external transfers or cross-channel transfers, if available and as approved by BAS FAST.

• Cash-in through agents or approved channels.

• Cash-out through agents or approved channels.

• QR code payments.

• Payment acceptance for merchants.

• Bill or service payments, if available.

• Support and complaint services.

• Any other services later approved by BAS FAST.

BAS FAST does not guarantee that all services will be available at all times, to all users, or in all regions, and may modify, suspend, or restrict any service for operational, security, compliance, or legal reasons.

15. Balance Within the Wallet

The balance displayed in the user’s account represents electronic value recorded within the BAS FAST system according to executed transactions and approved entries.

The user acknowledges that:

• The balance may only be used within the permitted services.

• The balance may be subject to usage, cash-out, or transfer limits.

• Certain balances may be under review or frozen in the event of a dispute, suspicion, or compliance request.

• BAS FAST may correct any technical, accounting, or operational error in the balance when detected.

• The existence of a balance in the account does not necessarily mean that the user has the right to withdraw or transfer it immediately if the account or balance is subject to a legitimate review or restriction.

16. Disputed Balance

When a dispute, suspicion, legal claim, compliance review, or objection to a transaction arises, BAS FAST may place the balance related to the case under review, freeze it, or hold it internally on a temporary basis until verification, settlement, or the applicable decision is completed.

This may include:

• A balance related to a disputed transaction.

• A balance related to a suspicious transaction.

• A balance resulting from a technical or accounting error.

• A balance related to a request from a competent authority.

• A balance subject to dispute between a user and a merchant, agent, or another party.

Freezing the disputed balance shall not be considered confiscation of it, but rather a temporary measure to protect rights and the integrity of the system until the review or settlement is completed.

17. Transactions and Execution of Operations

When executing any transaction, the user must verify:

• Accuracy of recipient details.

• Accuracy of the amount.

• Type of service.

• Currency used.

• Fees or commission, if any.

• Transaction details before confirmation.

BAS FAST may rely on instructions issued from the user’s account, device, or verification method as valid instructions issued by the user.

After a transaction is confirmed, certain operations may be final and irreversible, especially if:

• The amount has been transferred to another account.

• The amount has been paid to a merchant or service provider.

• The amount has been paid out in cash through an agent.

• The operation has been settled within the system.

• The operation has been executed according to the user’s correct instructions.

BAS FAST shall not be responsible for the user’s error in entering the recipient number, transaction amount, or selected beneficiary, unless an error by BAS FAST is proven according to its internal records.

18. Delaying, Rejecting, or Suspending Transactions

BAS FAST may delay, reject, suspend, or review any transaction in the following cases:

• Insufficient balance.

• Error or missing data.

• Fraud indicators or unusual activity.

• Incomplete KYC.

• Exceeding account or service limits.

• Compliance review.

• Existence of a dispute or claim.

• Technical or operational failure.

• Request by a competent authority.

• Suspicion of money laundering, terrorist financing, or misuse.

• Protection of the user, platform, agents, or merchants.

Suspending or delaying a transaction does not constitute proof of a violation, and may be a precautionary measure to protect the service, users, or compliance.

19. Correction of Errors

If a technical, accounting, operational, or settlement error is identified, BAS FAST has the right to correct the error according to its internal records.

Correction may include:

• Adding an amount.

• Deducting an amount.

• Freezing an amount.

• Cancelling an incorrect entry.

• Modifying the status of a transaction.

• Reprocessing an operation.

• Requesting clarification or documents from the user.

The user must notify BAS FAST immediately if the user notices any error in the balance, transactions, or account.

The user may not exploit any technical or accounting error or any balance credited by mistake, and BAS FAST has the right to recover any amount credited or used incorrectly.

20. Fees and Commissions

BAS FAST may impose fees or commissions on certain services, such as:

• Transfers.

• Cash-out.

• Cash-in, if applicable.

• QR payments.

• Merchant services.

• Agent services.

• Special or additional services.

• Inquiry, processing, or settlement services, where applicable.

BAS FAST seeks to display fees to the user before completing the transaction whenever technically and operationally possible.

BAS FAST may amend fees, commissions, or pricing models from time to time, and the amendment will be announced or notified in the appropriate manner according to the nature of the service.

Fees paid for a service that has been executed or correctly begun processing are non-refundable, unless BAS FAST decides otherwise or unless an error attributable to BAS FAST is proven.

21. Account and Transaction Limits

BAS FAST may impose limits on accounts and transactions, such as:

• Daily transfer limit.

• Monthly usage limit.

• Cash-out limit.

• Cash-in limit.

• Wallet balance limit.

• Limit based on account type.

• Limit based on KYC level.

• Limit based on risk level, region, or service type.

BAS FAST may modify these limits at any time for operational, financial, compliance, security, or regulatory reasons.

Limits may also be increased or reduced based on identity verification, account type, usage history, or risk assessment.

22. Authorized Agents

BAS FAST may provide some of its services through authorized agents, such as:

• Cash-in.

• Cash-out.

• Assistance with registration.

• Verification or support.

• Other operational services.

When dealing with agents, the user must:

• Ensure that the agent is officially authorized.

• Not hand over money except within clear official procedures.

• Not share the password, PIN, or OTP with the agent.

• Request a receipt or reference for the transaction when available.

• Report any suspicious behavior or unlawful request.

BAS FAST shall not be responsible for transactions carried out outside official channels, with unauthorized persons, or based on personal arrangements between the user and the agent.

BAS FAST has the right to restrict, suspend, or terminate the authorization of any agent in the event of policy violation, misuse of permissions, or risk to users or the platform.

23. Merchants and Commercial Payments

BAS FAST may enable merchants to accept payments from users.

The user acknowledges that BAS FAST is not a party to the sale or service contract between the user and the merchant, unless expressly stated otherwise.

BAS FAST’s responsibility is generally limited to processing the payment transaction within the system. It is not responsible for:

• Quality of the goods or service.

• Delivery of the goods or service.

• Merchant’s replacement or return policy.

• Commercial disputes between the user and the merchant.

• Prices, offers, or obligations presented by the merchant outside the BAS FAST system.

BAS FAST may assist the user in reviewing or proving a payment transaction according to available records, but it does not guarantee resolution of the commercial dispute in favor of any party.

24. Permitted Use

BAS FAST may only be used for lawful purposes and in accordance with these Terms, the approved policies, and applicable laws and regulations.

The user must:

• Use the account under the user’s real name or correct legal capacity.

• Provide accurate data.

• Use the service within the permitted limits.

• Comply with BAS FAST instructions.

• Not misuse the platform, agents, merchants, or support.

• Not use the service in a manner that harms users, the system, reputation, or compliance.

 25. Prohibited Activities

The user is prohibited from using BAS FAST directly or indirectly in any unlawful or prohibited activity, including:

• Money laundering or attempting to conceal the source or destination of funds.

• Terrorist financing or any prohibited activity.

• Proliferation financing or any similar prohibited activity, where applicable.

• Fraud, extortion, or identity impersonation.

• Use of forged documents or false data.

• Use of the account on behalf of others without authorization.

• Opening multiple accounts to circumvent limits or controls.

• Structuring transactions to bypass limits or review.

• Exploiting system errors or vulnerabilities.

• Attempting to hack, disrupt, or test systems without authorization.

• Using the service for unlawful gambling.

• Selling or purchasing prohibited goods or services.

• Passing funds of unlawful origin.

• Conducting transactions with parties listed on prohibition, sanctions, or suspicion lists where such lists or indicators are approved by BAS FAST or required under the applicable operating rules or relevant instructions.

• Using agents or merchants in a fraudulent or misleading manner.

• Sending harmful, offensive, or unlawful content through service-related channels.

• Any activity that BAS FAST considers to create legal, financial, security, or compliance risk.

Where a violation or reasonable suspicion exists, BAS FAST may take appropriate actions, including restriction, suspension, rejection, freezing, closure, or escalation to competent authorities.

26. Compliance, Anti-Money Laundering, and Counter-Terrorist Financing

BAS FAST applies internal compliance controls proportionate to the nature of its services, including:

• Identity verification.

• Risk assessment.

• Transaction monitoring.

• Customer due diligence.

• Enhanced due diligence when needed.

• Record keeping.

• Review of unusual activities.

• Fraud prevention.

• Anti-money laundering and counter-terrorist financing.

• Counter-proliferation financing where applicable.

• Cooperation with competent authorities where there is a legal or regulatory basis.

BAS FAST has the right to take any action it deems appropriate for compliance purposes, such as:

• Requesting additional information.

• Delaying a transaction.

• Rejecting a transaction.

• Suspending the account.

• Restricting certain services.

• Freezing a balance under review.

• Closing the account.

• Refraining from providing certain details if disclosure is prohibited or inappropriate for compliance, legal, or security reasons.

The user acknowledges that BAS FAST may not always be able to explain all reasons for restriction, suspension, or rejection if this is related to compliance, investigation, or non-disclosure requirements.

 27. Reporting and Non-Disclosure

BAS FAST may be subject to internal, legal, or regulatory obligations that prevent it from disclosing certain reasons to the user when taking measures related to suspicion, review, reporting, or cooperation with competent authorities.

The user acknowledges that BAS FAST has the right to comply with these requirements, including refraining from disclosing details of the review, the source of suspicion, the nature of internal procedures, or the authorities contacted, if disclosure may harm the investigation, compliance, system safety, or violate any legal or regulatory obligation.

28. User Responsibility in Compliance

The user must:

• Use the account for lawful purposes only.

• Provide accurate and complete information when requested.

• Cooperate with BAS FAST in any compliance review or verification.

• Not circumvent limits, classifications, or risk controls.

• Not enable others to use the account to bypass controls.

• Not use the account as a front for transactions or funds belonging to others without authorization or legitimate justification.

• Notify BAS FAST upon noticing any unauthorized use or suspicious transaction in the user’s account.

29. Privacy and Data Protection

The processing of personal, financial, and KYC data in BAS FAST is subject to the approved Privacy Policy.

Data protection procedures, system protection, access policies, permissions, and security incident management are subject to the Data Protection and Information Security Policy.

By using BAS FAST, you acknowledge that you have read and understood the policies related to privacy and data protection, and agree to the processing of your data in accordance with them.

BAS FAST does not sell users’ personal or financial data, and does not currently use user data for advertising tracking across third-party applications or websites, as explained in the Privacy Policy and the Data Protection Policy.

30. Cookies and Tracking Technologies

When using the website or certain digital interfaces, BAS FAST may use cookies or similar technologies for operational, security, or analytical purposes, such as:

• Operating the website.

• Maintaining sessions.

• Improving performance.

• Protecting accounts.

• Detecting fraudulent behavior.

• Improving the user experience.

The use of these technologies is subject to the BAS FAST Cookies and Tracking Technologies Policy.

31. Account Deletion and Closure by the User

The user may request account deletion through the application or through the official channels provided by BAS FAST.

When deletion is requested, BAS FAST has the right to:

• Verify the identity of the requester.

• Review the balance and pending transactions.

• Settle existing obligations.

• Close or disable the account.

• Delete or anonymize unnecessary data.

• Retain records that must or may be retained for legal, financial, accounting, compliance, or security reasons.

Account deletion does not mean that all data will be deleted immediately, especially KYC data, financial transaction records, compliance records, complaints, disputes, and fraud prevention records, as explained in the Privacy Policy and Data Protection Policy.

If the account contains a balance, pending transactions, a dispute, or a compliance review, BAS FAST may delay account closure or deletion of certain data until the matter is settled.

32. Suspension, Restriction, or Closure of Account by BAS FAST

BAS FAST may temporarily or permanently suspend, restrict, or close the account or any service related to it if any of the following occurs:

• Violation of these Terms or any related policy.

• Providing incorrect or misleading data.

• Failure to complete KYC.

• Suspicion of fraud, money laundering, or terrorist financing.

• Use of the account on behalf of others without authorization.

• Unusual or high-risk activity.

• Misuse of agents, merchants, or support.

• Attempt to hack or disrupt the system.

• Request from a competent authority.

• Security, legal, compliance, or operational risk.

• Long inactivity according to approved policies.

• Any other legitimate reason that BAS FAST considers necessary to protect the service, users, or compliance.

Upon closure or suspension, BAS FAST may retain certain data and records, and may settle, freeze, or review the balance according to approved policies and legal and compliance requirements.

33. Complaints and Objections

The user may submit a complaint or objection through the official BAS FAST channels.

The complaint should, where possible, include:

• User name.

• Phone number or account number.

• Transaction number, if any.

• Clear description of the issue.

• Any supporting documents or images.

BAS FAST reviews complaints within a reasonable period depending on the nature and complexity of the case. It may request additional information or documents to verify the request.

Submitting a complaint does not mean automatic acceptance of the complaint, and does not necessarily lead to reversal of the transaction, refund, or suspension of procedures. The outcome is subject to internal records, the nature of the transaction, and approved policies.

The user must update the user’s contact data, and any notice sent to the user’s registered contact methods shall be effective, unless an error by BAS FAST is proven.

35. Intellectual Property

All rights relating to BAS FAST are owned by BAS FAST, Emitis Group, or their licensors, including:

• Trade name.

• Trademarks and logos.

• Designs and interfaces.

• Software.

• Databases.

• Texts and content.

• Documents and policies.

• Operational guides.

• Codes and technical functions.

• Any other materials related to the service.

The user may not copy, modify, republish, sell, license, or exploit any part of BAS FAST without prior written consent.

Use of the service does not grant the user any ownership right in the platform, software, marks, or content.

36. Service Availability and Operational Changes

BAS FAST seeks to provide the service in a stable and secure manner, but does not guarantee that the service will always be available or free from errors or interruptions.

BAS FAST may at any time:

• Modify the service.

• Add new services.

• Suspend certain features.

• Restrict certain operations.

• Carry out maintenance.

• Update the application.

• Change the operating mechanism.

• Temporarily suspend the service for security, technical, or compliance reasons.

BAS FAST shall not be responsible for any interruption, delay, or failure resulting from causes beyond its reasonable control.

37. Limitation of Liability

To the extent permitted by applicable rules, BAS FAST shall not be responsible for:

• Indirect, consequential, or special damages.

• Loss of profits, opportunities, or reputation.

• Losses resulting from user error.

• Sending funds to an incorrect recipient due to data entered by the user.

• Sharing the password, PIN, or OTP.

• Use of unofficial channels or applications.

• Merchant actions outside the scope of the payment transaction.

• User dealings with unauthorized agents or outside official channels.

• Internet, electricity, or communication failures.

• Errors or negligence of external parties not under the control of BAS FAST.

• Security incidents or attacks that occur despite taking reasonable protection measures.

• Force majeure events.

Nothing in these Terms excludes the liability of BAS FAST where such exclusion is not permitted under applicable law.

8. Indemnification

The user agrees to indemnify BAS FAST, Emitis Group, their directors, employees, agents, and partners against any losses, claims, damages, expenses, or liabilities arising from:

• Violation of these Terms.

• Misuse of the service.

• Providing incorrect data or documents.

• Use of the account for unlawful purposes.

• Violation of the rights of others.

• Harm to the platform, users, agents, or merchants.

• Use of the account on behalf of others without authorization.

• Any act or omission that leads to a claim against BAS FAST due to the user’s conduct.

39. Force Majeure and Exceptional Circumstances

BAS FAST shall not be responsible for any delay, failure, or inability to perform its obligations if this results from force majeure or exceptional circumstances beyond its reasonable control, including:

• Wars, conflicts, or disturbances.

• Governmental or regulatory decisions.

• Electricity outage.

• Internet or communication outage.

• Natural disasters.

• Epidemics or public health circumstances.

• Large-scale cyberattacks.

• Failure of external systems or service providers.

• Closure or disruption of infrastructure necessary for operation.

BAS FAST may take temporary measures during such cases, such as restricting or suspending certain services, delaying transactions, or rescheduling certain operations in order to protect the system and users.

 40. Amendment of Terms

BAS FAST may amend these Terms from time to time for reasons including:

• Adding new services.

• Legal or regulatory changes.

• Operational or technical updates.

• App store requirements.

• Improving security and compliance.

• Amending fees or service limits.

• Developing the user experience.

The updated version will be published inside the application, on the website, or through any appropriate official channel.

41. Assignment or Transfer of Rights

The user may not transfer or assign the account, or authorize its use by others, without prior written consent from BAS FAST.

42. Invalidity of a Provision

If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.

The invalid provision shall be interpreted or amended to the extent necessary to make it enforceable in a manner that achieves the closest lawful purpose to the original text.

43. No Waiver

Failure by BAS FAST to exercise any of its rights, or delay in exercising such rights, shall not constitute a waiver of that right.

The exercise of any right once does not prevent BAS FAST from exercising it again or from exercising any other available right.

44. Governing Law and Dispute Resolution

These Terms, and the use of BAS FAST services, are governed by the laws and regulations in force and applicable within the scope of BAS FAST operations in North and East Syria, taking into account any additional requirements that may apply to certain services, users, or operations outside that scope.

The parties shall first seek to resolve any dispute, complaint, or disagreement amicably through the official BAS FAST channels.

If an amicable resolution is not possible, the dispute shall be referred to the competent judicial, legal, or relevant authority having jurisdiction according to the applicable rules, the nature of the dispute, its location, and the scope of the service.

45. Language

These Terms may be made available in multiple languages. In the event of any difference in interpretation between versions, the version officially adopted by BAS FAST for the specific legal or operational purpose shall prevail.

• You understand that BAS FAST provides digital financial services that require verification, compliance, and risk monitoring.

• You are responsible for protecting your account, login data, and verification codes.

• You agree that BAS FAST has the right to restrict, suspend, reject, or close the account or transactions where there is a legitimate reason relating to security, compliance, law, or system safety.

• You understand that BAS FAST may not always be able to disclose the reasons for certain restriction, suspension, or rejection measures if this relates to compliance, investigation, or non-disclosure requirements.

• You understand that some transactions may be final and irreversible after execution.

• You understand that account deletion does not mean immediate deletion of all records, especially KYC records, financial transaction records, and compliance records.
